Welcome to Monocled Moose Studios. These Terms of Service ("Terms") govern your access to and use of monocledmoosestudios.com (the "Site") and any content, games, artwork, writing, or other materials we publish through it. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
"Monocled Moose Studios," "we," "us," and "our" refer to Monocled Moose Studios, an independent game studio. "You" means the visitor or user of the Site.
You may browse the Site for personal, non-commercial purposes. You agree not to: attempt to gain unauthorized access to the Site or any server we use to host it; interfere with the operation of the Site (for example, through scraping that degrades performance, denial-of-service activity, or automated attacks); misrepresent yourself or impersonate us; or use the Site in any way that violates applicable law.
All content on the Site — including logos, artwork, illustrations, written copy, game titles, character designs, audio, and trade dress — is owned by Monocled Moose Studios or used with permission, and is protected by copyright, trademark, and other laws. Except where we have explicitly granted a license (for example, within a published game product), you may not copy, redistribute, adapt, publicly display, or create derivative works based on our content without our prior written consent.
Certain products referenced on the Site may incorporate third-party intellectual property (for example, the Dungeons & Dragons 5th Edition Systems Reference Document) under the terms of those third parties' licenses. The rights in those third-party materials belong to their respective owners.
The Site may link to third-party platforms where our work is sold or hosted — including Kickstarter, itch.io, DriveThruRPG, Steam, and similar services. Your transactions on those platforms are governed by the platforms' own terms and policies, not ours. We are not responsible for third-party content, products, or services.
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, Monocled Moose Studios and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site — even if we have been advised of the possibility of such damages.
You agree to indemnify and hold harmless Monocled Moose Studios and its contributors from any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.
We may modify, suspend, or discontinue any part of the Site at any time, and we may update these Terms by posting a revised version here and updating the "Last updated" date. Your continued use of the Site after changes take effect means you accept the revised Terms.
These Terms are governed by the laws of the United States and the state in which Monocled Moose Studios is organized, without regard to conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in that state, and you consent to the jurisdiction and venue of those courts.
